1. Introduction & Acceptance 

Welcome to CNY Tree Service LLC (“CNY,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern (a) all tree-care services we perform—including tree removal, tree trimming, stump grinding, emergency response, inspections, and related site work (“Services”)—and (b) your use of our website located at cnytreeservice.com (“Site”). By approving a written proposal, signing a work order, submitting a form, making a payment, or accessing the Site, you (“Client,” “you,” or “your”) agree to be bound by these Terms. 

If you do not agree, please refrain from using the Site or scheduling Services. 

2. Definitions 

  • Proposal / Estimate – our written scope of work, price, and Schedule. 
  • Work Order – the signed authorization to proceed. 
  • Property – the physical location where Services are performed. 
  • Hazardous Material – any substance regulated as toxic, dangerous, or bio-hazardous. 

3. Scope of Services 

We perform residential, commercial, and industrial tree-care Services in accordance with ANSI A300 pruning standards, ANSI Z133 safety requirements, and applicable New York State regulations. Unless otherwise stated in writing: 

  • Wood debris up to 6 inches in diameter is chipped on-site; larger wood is cut into manageable lengths and left on Property. 
  • Stump grinding reaches a depth of 6–12 inches below grade; root chase is limited to 24 inches from stump edge. 
  • Surface-level cleanup is included; fine raking, seeding, or landscaping restoration is an optional add-on. 
  • Underground utilities are located via Dig Safely NY (811). We are not responsible for unmarked private lines (irrigation, pet fences, etc.). 

4. Estimates, Pricing & Change Orders 

  1. Validity. Written Estimates are valid for 30 days unless otherwise noted. 
  2. Hidden Conditions. If concealed obstacles (rock, concrete, foreign objects, nesting wildlife, decay) cause additional labor or equipment expense, we will issue a written Change Order for Client approval before proceeding. 
  3. Hourly Work. Emergency or time-and-material tasks are billed in 30-minute increments with a two-hour minimum unless specified. 
  4. Taxes & Fees. Prices exclude sales tax, permit fees, or disposal surcharges unless itemized. 

5. Scheduling, Access & Client Responsibilities 

  • Provide clear, safe access to the work area, including gate codes or keyholder presence. 
  • Remove vehicles, patio furniture, pets, and fragile items within the designated drop zone. 
  • Notify neighbors and obtain HOA permissions if required. 
  • Water, gas, and power must remain available for equipment operation unless hazardous. 

Failure to provide access may result in rescheduling fees up to 20 % of the job value. 

6. Cancellation & Rescheduling 

  • ≥ 48 hrs notice: no fee. 
  • 24–47 hrs notice: 10 % of job value or $150, whichever is greater. 
  • < 24 hrs notice or crew on site: 20 % of job value plus mobilization costs. 

Weather-related delays are rescheduled at the earliest safe opportunity without penalty. 

7. Payment Terms 

  • Residential: 50 % deposit at scheduling; balance due upon completion. 
  • Commercial / Industrial: Net 15 unless otherwise agreed. 
  • Late Fees: 1.5 % per month (18 % APR) on past-due balances plus collection costs. 
  • Forms of Payment: Cash, check, major credit cards, ACH. Returned checks incur a $35 fee. 

8. Safety & Hazardous Conditions 

We maintain $2 million general liability insurance, workers’ compensation, and CDL coverage. Client agrees to keep all persons, pets, and property occupants outside the fenced drop zone and to comply with crew instructions. We may suspend work if unsafe conditions exist; additional costs caused by third-party interference are the Client’s responsibility. 

9. Permits, Easements & Compliance 

Unless stated, Client is responsible for obtaining homeowner-association or municipal approvals. We handle municipal tree-work permits when explicitly included in the Proposal. Client represents that all Property boundaries, easements, and right-of-way issues are settled. 

10. Limited Warranty 

We warrant workmanship for 30 days after completion. Natural events (storm, wind, lightning), regrowth, or diseases unrelated to our cuts are excluded. Stump grinding warranties exclude re-sprouting of invasive species (e.g., Ailanthus) unless chemical treatment was expressly included. 

11. Limitation of Liability 

To the fullest extent allowed by law, our aggregate liability arising from Services or Site use shall not exceed the total amount paid for the specific job giving rise to the claim. We are not liable for indirect, consequential, or special damages, including lost profits, business interruption, or diminution of property value. 

12. Indemnification 

Client agrees to defend, indemnify, and hold CNY, its owners, employees, and subcontractors harmless from all claims, damages, liabilities, and expenses arising out of (a) Client’s breach of these Terms, (b) inaccurate information supplied by Client, or (c) conditions on the Property not disclosed to us. 

13. Force Majeure 

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including severe weather, labor disputes, epidemics, supply-chain interruptions, or governmental actions. 

14. Photo / Video Release 

We may photograph or record the work process for safety documentation, training, or marketing. Images will not identify Client by name or address without written consent. 

15. Intellectual Property & Website Use 

All Site content—including text, graphics, photos, and logo—is the property of CNY or its licensors and protected by U.S. copyright law. You may not copy, modify, or distribute content without written permission. Unauthorized scraping, framing, or reverse engineering is prohibited. 

16. Third-Party Links 

Our Site may link to external websites. We are not responsible for the content, privacy practices, or accuracy of third-party sites. 

17. Changes to Terms 

We may update these Terms at any time by posting a revised version on the Site. Continued use of Services or the Site after changes constitutes acceptance. 

18. Governing Law & Dispute Resolution 

These Terms are governed by the laws of the State of New York without regard to conflict-of-law rules. Any dispute shall be resolved in the state courts of Broome County, NY. The prevailing party is entitled to reasonable attorney’s fees and costs. 

19. Severability 

If any provision is found unenforceable, the remaining provisions remain in effect. 

20. Entire Agreement 

These Terms, together with any signed Proposal or Work Order, constitute the entire agreement between the parties and supersede all prior discussions, emails, or representations.
